The Meningitis Outbreak: Who’s Really Responsible?
The owner of NECC Barry Cadden was subpoenaed by The House of Representatives at a hearing in Washington, D.C. on Nov. 14, but Cadden declined to testify by evoking his Fifth Amendment rights. The NECC declared bankruptcy soon after.
Members of Congress feel the FDA could have prevented the meningitis outbreak due to its lax oversight on compounding pharmacies in general. This oversight is left to the state pharmacy boards to monitor and in most cases, they do very little to protect the rights of citizens.
But according to officials, the FDA something was amiss at NECC. In 2006, the FDA issued a warning letter to the compounding pharmacy, accusing it jeopardizing the sterility of their drugs due to faulty packaging.
The FDA knew what was going on, but failed to act.
